So. Cal High School Sued for Silencing a Student on Illegal Immigration
Just passing along a story that absolutely galls me. The school allows students to "intentionally and illegally walk out of school" on March 27, 2006 to support the illegal alien invasion of the U.S., but when another student attempts to organize a counter protest, he was suspended for passing out flyers announcing the counter protest!
I am so friggin' sick of all the GD political correctness that infects our society. It makes me want to run right down to our border with truckloads of bricks and start building a damn wall since our government so clearly and obviously doesn't even give a rat's arse about protecting our borders and sovereignty. For the school to allow bratty children to completely disregard rules and support lawbreakers but then turn around and suspend a student for passing out flyers ... it's beyond me. I think the school administrators need to be sent to a loony bin for the rest of their sorry lives.
Anyway, now that I've thoroughly worked myself into a frenzy, here's the press release ...
(June 1, 2006 Riverside, CA) The public interest firm of Lively, Ackerman & Cowles filed suit on behalf of Jurupa Valley High School student Joshua Denhalter on Thursday afternoon. The First Amendment suit alleges that the high school has intentionally interfered with his right to speak out on the issue of illegal immigration. He alleges that on March 27, 2006, dozens of students, mostly of Mexican-American descent, illegally walked out of school in protest of legislation (HR4437) that was being proposed by the U.S. Congress concerning illegal immigration. He was not one of these students and chose to act lawfully.
Instead of illegally walking out of school and being truant, Plaintiff chose to organize a legitimate and lawful counter-protest/assembly during the lunch hour on or about March 30, 2006. The peaceable assembly was to take place across from the school on a public sidewalk (i.e., a traditional public forum).
The peaceable assembly would not have disrupted school activities because Jurupa Valley High School has an “open lunch” period. This means that students are free to come and go during this time. As such, any student could have “walked out” during the lunch to attend the assembly and there would be no disruption or violation of truancy laws.
On the morning of March 30, 2006, Plaintiff began handing out flyers for his event. That same morning, around 7:30 AM, he was approached by school officials and told that he could not hand out flyers advertising his First Amendment protected activities. He refused to give up his right to pass out handbills/flyers. As a result of his refusal to give up his constitutional rights, Plaintiff was suspended for “handing out flyers (before school) advocating the disruption of school activities”. However, the school did not punish the dozens of students who walked out in violation of the law several days before.
Furthermore, between March 27 and March 30, 2006, Defendants allowed MECHA to sponsor an on-campus rally in opposition to HR4437. Denhalter asked for permission to sponsor a similar rally on campus but was flatly denied by the JUSD school board.
Finally, just the week before filing of this complaint, on or about May 25, 2006, Defendants, and their “authorized” representatives, prohibited Plaintiff from wearing a “Save Our State” t-shirt by telling him that he needed to turn the shirt inside out and not ever where it again. The content of the political speech set forth on the shirt was the sole basis for this censorship and prior restraint of Plaintiff’s rights. Plaintiff seeks a TRO allowing him to express himself freely as to political matters until the end of the school year (i.e., June 21, 2006).
According to lead attorney for the plaintiff, “This is one of the worst governmental censorship cases I have seen in over a decade of practice. It is simply unbelievable that a school district would take sides with those who promote illegal activity over a student wishing to express his protected views in a traditionally and legally acceptable manner. These officials must be severely punished for their actions.” The law firm is handling this matter on a pro bono basis. The firm says that temporary restraining orders will be sought against the school within the next ten days.

Posted by Kasey on June 6, 2006 09:48 PM | Filed Under: ImmigrationThis is just plain BS. Illegal activities are fine and dandy but trying to do something legal in this country will get you suspended or thrown in jail. When will the people with the power get their heads out of their asses?
Posted by: Bruce on June 7, 2006 05:54 AMBruce, I guess you and I and approximately 80% of legal residents of the U.S. are all wondering the same thing. "Why have they chosen to stick their heads up their arses? Why are they happily bending over to be screwed by the illegal alien and/or the pro-Latino, pro-Hispanic and pro-Chicano lobbies? " Hell, you never know what politically correct name to use anymore. About 15 years ago, they wanted to be called "Chicanos," ala MeCha. Then, a few years later, they became "Hispanics" or "Latinos." They keep changing their descriptive name all the time, and if you don't keep up with what they want to be called today, well then, it's obvious that you're a racist and a cultural xenophobe, now isn't it? But they can sure as hell call us "gringos," and we'd better not even flinch, right? And those folks claim that WE are the racist people, not them!
There is such an obvious bias on the part of our PUBLIC (a.k.a. funded by you and me, Mr. and Mrs. Taxpayer) schools, our ELECTED officials and big business to promote anything Latino/Hispanic/Chicano while at the same time squelching anything or anyone that expresses pro-American or anti-illegal alien sentiment. I thought the Consitution guaranteed all citizens of the United States the right to free speech. Apparently, free speech is only allowed in this country to folks who broke our federal immigration laws and then decided they wanted to demonstrate for their "rights." (News flash, you stupid idiots ... You're not citizens or legal residents of this country ... Our Constitution guarantees you zero, zilch, nada. You have NO RIGHTS in this country.)
Ugh, I hate to say it, and I hate to sound like a conspiracy theorist, but I really think this kind of repression of free speech for true-blue Americans is all boiling down to the stories I keep hearing about Canada, the U.S. and Mexico becoming one big union called the "North American Union" to be modeled after the European Union. After all, creation of a North American Union was the main point of a summit meeting in March 2005 between our illegal-alien-loving Bush-whacker in the White House, Mexican President Fox (who absolutely sickens me with his arrogance to come to the U.S., speak in front of some of our state governments and essentially demand that we stop enforcing our southern border), and Canadian Prime Minister Martin back in March 2005.
Think I'm crazy? Think again. That summit meeting created what is now known as the Security and Prosperity Partnership of North America ( http://www.spp.gov/ ). The Council on Foreign Relations ( http://www.cfr.org/publication/8102/building_a_north_american_community.html ) even spelled out the erasing of our borders by these so-called "leaders" in a May 2005 report titled "Building a North American Community" ( http://www.cfr.org/content/publications/attachments/NorthAmerica_TF_final.pdf ).
So laugh all you want, but unfortunately, I think it's inevitable that you and I will soon become citizens of the United States of Canexico or some other such hybridized name. You know, Australia is looking better and better with each passing month...
Posted by: Kasey on June 7, 2006 07:39 AMAustralia's gun-laws kinda really seriously suck.
Posted by: DirtCrashr on June 9, 2006 06:35 PMAustralia's gun laws may be seriously lacking, but at least (as far as I know), the Australian Prime Minister and the rest of Australia's Parliament aren't conniving and scheming against their citizens.
Posted by: Kasey on June 9, 2006 07:20 PMSorry it's taken so long to get back to this.
I am fed up with all the elected officials in office. It is time to start term limits with a maximum of one term and do away with the retirement package these people get when they leave office.
Once they get in they are there forever it seems and they aren't there helping their communities, they are there out of greed. And I believe this is what is driving this illegal alien crap. Someone is greasing their pockets. They have to be. Nobody in their right mind would be going along with this.
As for a North American Union, I don't think Canada really wants anything to do with us. Do you think they want to give up their basic health care rights? Something that this country should be striving to create to stop you and I the average tax payer from taking it in the arse.
Posted by: Bruce on June 16, 2006 09:01 AMOnce again, Bruce, you've got a very valid point about Canada not wanting to become part of the North American Union. But it probably doesn't matter much what the people of Canada want, just as it doesn't matter what the people of the United States want. Think about it. If what we want actually mattered, then our leaders wouldn't constantly be trying to push all this illegal alien bovine excrement down our throats.
Basically, the way I see it, if the leaders of each country (Canada, U.S., Mexico) decide that they want something, then they'll get their way, by hook or by crook.
Heck, I don't want to become a part of any kind of union between Canada, the U.S. and Mexico any more than I'm sure Canada would want to become part of such an organization. The only country that would truly benefit is Mexico because they are a third world country; Mexico would be bolstered, but the U.S. and Canada would be brought down. An equilibrium would be attained, but such an equilibrium is certainly not in the best interest of two "first world" countries that would have to take on the problems of a third world country. Heck, we've got enough problems of our own than to go inviting a third world nation to bring its problems and impoverished people to us to handle.
Posted by: Kasey on June 16, 2006 03:52 PMHey all, I was reading this thread and thought I'd leave this:
Go to our site, www.alamoalliance.org and sign the petition opposing the Senate's Amnesty Plan. With your help, we can beat this fiasco.
Thanks
